GENERAL: The Golf Loft belongs to Benz Indoor Golf GmbH, located at Zwischen den 15c in 64625 Bensheim.

The managing directors with sole power of representation are Christopher Benz and Moritz Benz.

I. SCOPE

The following general terms and conditions apply exclusively to the business relationship between Benz Indoor Golf GmbH and the customer in the version valid at the time of the order. Any terms and conditions of the customer do not become part of the contract unless confirmed in writing by Benz Indoor Golf GmbH, even if Benz Indoor Golf GmbH does not expressly object to them. The following conditions become effective when users, fellow players and visitors enter the outdoor and indoor facilities of Benz Indoor Golf GmbH.

II. CONCLUSION OF CONTRACT

The offers of Benz Indoor Golf GmbH in the booking portal are non-binding. By clicking the order button, the customer declares to Benz Indoor Golf GmbH that he or she wishes to purchase the contents of the shopping cart at the stated price. The contract is only concluded after the order has been sent. Acceptance of the offer is usually made by a confirmation email to the email address provided by the customer. Bookings can also be made by telephone or email.

III. PAYMENT METHODS

The purchase price is due in full immediately upon ordering. The customer can pay the purchase price by credit card. Payment by credit card requires the credit card number, card verification code and expiration date to be entered in the relevant input fields in the order dialog and, if necessary, authentication within the respective 3-D Secure process of the relevant credit card organization (MasterCard Securecode, Verified by Visa). The purchase price can also be paid by card on site. Benz Indoor Golf GmbH insists on cashless payment transactions.

IV. TARIFFS

Our prices include the statutory VAT of currently 19%. The prices are always available online on the website www.thegolfloft.de or in the premises. Our membership prices are monthly prices and can be found in the price list. All prices for individual bookings are due upon booking.

V. SCOPE OF SERVICES

The booking entitles the customer to use the booked simulator for the agreed time. The customer has no right to use a specific simulator; Benz Indoor Golf GmbH is free to provide another simulator in the same price segment for organizational reasons. Booking a single lesson entitles the customer to use the simulator for 55 minutes. After the booked playing time has expired, the simulator must be left without being asked. If a customer exceeds the time slot they have booked, they must pay the full amount for the next time slot. Billing is done per 60 minutes. If more people turn up for a game than stated in the booking, the difference between the booked and the applicable rate must be paid on site for the additional people. If no additional payment is made, excess players will be refused access to the simulator. Bookings are only possible within the capacity limits of the facility. There is no guarantee that the desired booking date will be available. This also applies to the availability of the game quota included in the membership fee. If a customer arrives more than 10 minutes late for their booking without prior notice, Benz Indoor Golf GmbH reserves the right to rent the simulator to someone else. The booking is not transferable. Resale is not permitted.

VI. CANCELLATIONS

A booking can be cancelled by either party up to 24 hours before the start of the booking, free of charge by the customer. If a booked appointment is cancelled by the customer less than 24 hours before the start of the booked appointment, the customer must pay compensation of 100% of the booking price. If the cancellation is made by Benz Indoor Golf GmbH, the customer will be informed of the cancellation by email. The customer has no right to claim damages. The individual price paid must be refunded in full by Benz Indoor Golf GmbH. If the booking is free as part of a membership, the customer will be deducted from the game quota in the event of a no-show or late cancellation. The customer is expressly permitted to provide evidence that the provider has suffered no damage or significantly less damage.

VII. MEMBERSHIPS/CONTRACT TERM

Our membership prices are monthly prices and can be found in the price list. If the contract is concluded during the calendar month, the contract runs until the same day of the following month for each full calendar day. The membership fee for a contract concluded during the course of a month is due upon conclusion of the contract.

VIII. CLOSURES OF THE PLANT

Benz Indoor Golf GmbH is entitled to close the facility during the summer months.

IX. WARRANTY AND LIABILITY

The customer is entitled to all services booked by him, which are made available on the corresponding day. He is not entitled to the complete and uninterrupted operation of all simulators. Operational disruptions or the failure of individual simulators for a whole day do not constitute a defect. If the service is not used during the validity period of the booking, the customer is not entitled to a refund of the purchase price or to be granted access on another day. Benz Indoor Golf GmbH is generally not liable for personal injury or property damage, except in cases where this was caused intentionally or through gross negligence. Benz Indoor Golf GmbH is not liable for damage to golf equipment brought by the customer that is damaged during use of the simulators. The use of the simulators and the use of the rental equipment provided by Benz Indoor Golf GmbH is at your own risk. The customer is fully liable for all damage caused by him, unless it is normal wear and tear or material defects. Before the start of the game, every user must check that the box they are using is in good condition, in particular that it is undamaged, and report any defects or damage immediately. Otherwise, damage will be attributed to the last customer, who will be responsible for the resulting damages. Benz Indoor Golf GmbH is not obliged to keep any items left behind or other lost property. Furthermore, any further liability based on a negligent breach of duty is excluded. The liability limitations also apply with regard to the personal liability of employees, vicarious agents, legal representatives or bodies of Benz Indoor Golf GmbH.

X. RULES OF USE

The simulators may only be entered with clean shoes. Clubs brought along may be used, but must not be dirty. The simulators may only be played with clean, unmarked balls.

Bringing and consuming food and drinks is not permitted.

XI. HOUSE RULES

Benz Indoor Golf GmbH exercises its house rules. Benz Indoor Golf GmbH is entitled to issue expulsions or bans from the premises or to take other appropriate measures within the scope of its house rules. Visitors can be expelled in particular if they harass other visitors or have violated the general terms and conditions or the rules of use in any other significant way or repeatedly.

XII. SALVATION CLAUSE

In the event that individual provisions of this contract are or become invalid or unenforceable in whole or in part, or in the event that this contract contains gaps, this shall not affect the validity of the remaining provisions of this contract.
